The Hon’ble Karnataka High Court had quashed the Order of CSTAA and held that inter-state movement of goods in this specific case were merely ‘Stock Transfers’ on October 14, 2022
BASF India Limited on Thursday said that it has received notice from the Commercial Tax Department, Karnataka that the Department has filed a Special Leave Petition (SLP) before the Hon’ble Supreme Court against the Order of the Hon’ble Karnataka High Court, which is subject to admission.
On November 1, 2022, BASF India Limited had informed the stock exchange regarding the favourable order passed by the Karnataka High Court dated October 14, 2022, by allowing the Writ Petition filed by the company against the Order passed in 2019 by the Central Sales Tax Appellate Authority, New Delhi (CSTAA) in respect of demand notices from the Commercial Tax Department, Karnataka aggregating to Rs. 764.01 crores (including interest and penalty) for the tax periods April 2006 to June 2017 by treating the stock transfers of its Mangalore Plant as interstate sales to dealers.
The company had filed its detailed response to the then demand notice. The Hon’ble Karnataka High Court had quashed the Order of CSTAA and held that inter-state movement of goods in this specific case were merely ‘Stock Transfers’.
BASF India informs the stock exchange the company has received intimation on 26th September, 2023 that the Tax Department has filed a Special Leave Petition before the Hon’ble Supreme Court against the aforesaid Order of the Hon’ble Karnataka High Court, which is subject to admission.
