Demystifying draft CMSR at NextGen Chemicals & Petrochemicals Summit 2021

India has been developing a comprehensive strategy for chemical regulation for some time now. The approach reflected in Indian Chemicals Management and Safety Rules (CMSR) aligns with other countries’ approaches and uses fairly standard notification, registration, and evaluation measures. 

In such a backdrop, the leading chemical industry experts will throw light on various aspects of CMSR at the ‘NextGen Chemical and Petrochemical Summit 2021’ being organized by Indian Chemical News from 7-8 October, 2021. Titled as ‘Indian CMSR Technical Session’, the discussion will take place on the first day of the virtual summit. The main theme of the event is "Moving in the big league."

The discussion will focus on topics such as overview of CMSR and timeline for implementation, required information for substance notification and registration, overlaps and scope issues of the CMSR with other regulations in India, timeline and fee, and compliance strategies.

The 5th Draft of the CMSR is in circulation and it is expected that Indian CMSR will come into force this year and will require notification (with additional data requirements) of all substances and full registration of approximately 750 ‘Priority’ Substances within 18 months after the rules come into force. Given a relatively short timeline, preparation for timely compliance with CMSR is highly recommended. 

By incorporating elements from established governance frameworks including REACH in the European Union and K-REACH in Korea, India is deploying a mechanism that is familiar to global chemical stakeholders. India’s framework deploys unique elements that are expected to generate confusion and some level of discord among manufacturers, importers, and downstream users. 

India’s notification program will allow impacted companies an opportunity to consider strategically how substances are introduced into India, as there are fees and distinctive data elements. Companies currently placing substances and mixtures on the market in India are urged to consider the implications of notification and registration requirements for any claim they may wish to assert as confidential.
