India has imposed Anti-Dumping Duty on phosphoric acid of all grades and all concentrations (excluding Agriculture/Fertilizer grade) originating in or exported from South Korea (subject country) for five years in order to safeguard domestic manufacturers from cheap imports.
In a gazette notification of the Department of Revenue, Ministry of Finance dated August 21, 20202, it is announced that “The Anti-Dumping Duty (USD 137 per metric tonne) imposed under this notification shall be effective for a period of five years (unless revoked, superseded or amended earlier) from the date of publication of this notification…and shall be paid in Indian currency.”
The Directorate General of Trade Remedies (DGTR), responsible for carrying out investigations and recommending the amount of anti-dumping duty/countervailing duty on the identified articles, argued that there is continued dumping of the subject goods from subject country and the imports are likely to enter the Indian market at dumped prices in the event of expiry of duty. The domestic industry has suffered continued injury on account of dumped imports from the subject country, the notification reads and adds that the information on record shows likelihood of continuation of dumping and injury in case the anti-dumping duty in force is allowed to cease at this stage. Moreover, there is sufficient evidence to indicate that the revocation of anti-dumping duty at this stage will lead to continuation of dumping and injury to the domestic industry.
